EU Digital Services Act Is Reshaping Adult Content Platforms —
The EU's Digital Services Act imposes strict transparency, content moderation, and risk assessment obligations on adult platforms. Here's how it works.

The European Union's Digital Services Act (DSA), formally Regulation (EU) 2022/2065, has been fully applicable to all in-scope platforms since February 17, 2024. For adult content platforms — including OnlyFans, Fansly, Pornhub, and dozens of smaller services — the DSA introduces a regulatory framework that is fundamentally different from anything they have faced before.
This is not a "terms of service" update. The DSA is a binding EU regulation with direct effect in all 27 member states. It creates mandatory obligations backed by fines of up to 6% of a platform's global annual turnover. For a platform like OnlyFans — whose parent company Fenix International reported gross payment volume exceeding $6 billion in recent years, with platform revenue (the 20% commission) representing a substantial fraction — the theoretical fine ceiling is measured in hundreds of millions of dollars. The exact calculation depends on how "annual turnover" is defined under the DSA: gross transaction volume or net platform revenue. The European Commission has not yet issued definitive guidance on this calculation for marketplace-type platforms, but either interpretation produces a figure large enough to constitute an existential threat.
What the DSA Requires: A Structural Overview
The DSA creates a tiered system of obligations based on platform size and function. The tiers relevant to adult content platforms are as follows.
All Intermediary Services (Article 11-15)
Every platform operating in the EU must designate a single point of contact for EU member state authorities (Article 11), publish a legal representative in the EU if not established in a member state (Article 13), and include clear terms of service that explain content moderation policies, including algorithmic decision-making (Article 14).
Hosting Services, Including Content Platforms (Articles 16-18)
Platforms that store user-generated content must implement notice-and-action mechanisms allowing anyone to report illegal content (Article 16). When a platform removes or restricts content, it must provide the affected user with a clear, specific statement of reasons (Article 17). Platforms must also report suspected criminal offenses involving threats to life or safety to relevant law enforcement in the member state concerned (Article 18).
Online Platforms (Articles 19-28)
Platforms that disseminate content to the public — which includes all major adult content subscription and tube sites — face additional requirements. These include an internal complaint-handling system that allows users to contest content moderation decisions (Article 20), access to certified out-of-court dispute resolution bodies (Article 21), cooperation with "trusted flaggers" — organizations recognized by member state Digital Services Coordinators as having particular expertise in identifying illegal content (Article 22), and suspension of service to users who frequently provide manifestly illegal content (Article 23).
Platforms must also publish transparency reports every six months detailing the volume of content moderation actions, the number of complaints received and their outcomes, and the use of automated content moderation tools, including error rates (Article 24).
Very Large Online Platforms — VLOPs (Articles 33-43)
Platforms with more than 45 million monthly active users in the EU are designated as Very Large Online Platforms (VLOPs) and face the most demanding obligations. The European Commission designated the first batch of VLOPs in April 2023. As of 2026, Pornhub's parent company Aylo has been assessed for potential VLOP designation based on EU traffic data, though the formal designation process is ongoing.
VLOPs must conduct annual systemic risk assessments evaluating risks including the dissemination of illegal content, negative effects on fundamental rights (including privacy and dignity), and negative effects on minors (Article 34). They must implement reasonable, proportionate, and effective mitigation measures to address identified risks (Article 35) and submit to independent audits of their compliance at least once per year, conducted by organizations meeting the criteria in Article 37.
VLOPs must also provide researchers with access to data necessary to study systemic risks (Article 40) and appoint compliance officers who are independent of the platform's commercial functions (Article 41).
How This Applies to Adult Content Platforms Specifically
The DSA was not written specifically for the adult content industry, but several of its provisions have outsized impact on adult platforms.
Age Verification and Minor Protection
Article 34(1)(d) requires VLOPs to assess risks to minors. Article 35(1)(j) requires mitigation measures including "age verification mechanisms." The DSA does not prescribe a specific age verification method, but the European Commission's guidance, published in February 2024, strongly recommends methods that go beyond self-declaration.
This has practical consequences. Platforms that previously relied on a checkbox stating "I am 18 or older" cannot credibly claim compliance. The Commission's guidance cites the French CNIL's framework for age verification — which recommends third-party verification systems that do not require platforms to collect government ID directly — as a reference model.
OnlyFans, which already requires ID verification for creators but not for subscribers, has begun implementing enhanced age verification for EU-based users in compliance with the DSA and parallel national laws, including France's Loi SREN (Loi pour Securiser et Reguler l'Espace Numerique) enacted in 2024, which mandates technical age verification for access to adult content.
Content Moderation at Scale
Article 14 requires platforms to explain their content moderation policies in clear, plain language. For adult platforms, this creates a specific challenge: content policies must clearly delineate what is permitted and what is not, including the standards for legal adult content versus illegal material such as non-consensual intimate images (NCII), content depicting minors (CSAM), or content that violates specific member state obscenity laws.
The transparency reporting requirements (Article 24) mean that adult platforms must now publicly disclose how much content they remove, why, and how often their automated detection systems produce false positives. This data was previously treated as proprietary.
The "Illegal Content" Problem
Article 3(h) defines "illegal content" by reference to EU and member state law. This creates a significant compliance challenge for adult platforms because what constitutes "illegal" adult content varies across EU member states.
For example, Germany's Strafgesetzbuch (Criminal Code) Section 184 criminalizes distribution of pornography to minors and certain categories of content (Section 184a: content depicting violence; Section 184b: child sexual abuse material). France's Code penal Article 227-24 criminalizes making pornographic content available to minors. Poland's Kodeks karny Article 202 criminalizes certain categories of pornographic production and distribution.
A platform operating across all 27 member states must understand and comply with the content laws of each. The DSA does not harmonize these underlying content laws — it only harmonizes the procedural framework for addressing illegal content.
Notice-and-Action Obligations
Article 16 requires platforms to implement "easy to access, user-friendly" mechanisms for reporting illegal content. Reports must include an explanation of why the content is allegedly illegal, the electronic location (URL) of the content, the name and email address of the reporting individual, and a statement confirming the good faith of the report.
Platforms must act "in a timely, diligent, non-arbitrary and objective manner" on reports (Article 16(6)). The DSA does not specify a hard deadline for action, unlike some national laws. However, the European Commission has indicated in its enforcement guidance that platforms should process reports within 24 hours for clearly illegal content and within 72 hours for content requiring assessment.
For adult platforms, this means building or scaling content moderation teams capable of handling a potentially high volume of reports — not just for CSAM or NCII, but for any content reported as violating any EU member state's laws.
Enforcement: Who Polices This
The DSA is enforced through a dual structure.
National Digital Services Coordinators (DSCs) in each member state oversee platforms established in their territory. Under the DSA's "country of origin" principle, a platform is primarily regulated by the DSC in the member state where it is established. For OnlyFans (established in the UK, which is not an EU member state), the DSC in the member state where it has designated its legal representative serves as the primary regulator.
The European Commission has direct supervisory authority over VLOPs and Very Large Online Search Engines (VLOSEs). The Commission can initiate investigations, request information, conduct on-site inspections, and impose fines.
Penalty Structure
Non-compliance with DSA obligations: Fines of up to 6% of the platform's global annual turnover (Article 52(3)).
Providing incorrect, incomplete, or misleading information in response to a Commission request: Fines of up to 1% of global annual turnover (Article 52(2)).
Failure to submit to an on-site inspection: Fines of up to 1% of global annual turnover (Article 52(2)).
Periodic penalty payments for ongoing non-compliance: Up to 5% of average daily global turnover per day (Article 52(4)).
The Commission opened its first formal proceedings under the DSA against X (formerly Twitter) in December 2023, and against TikTok and AliExpress in early 2024. As of March 2026, no formal proceedings have been publicly initiated against adult content platforms, but the Commission has sent requests for information to several platforms regarding their minor protection and content moderation practices.
What This Means for Creators
Content Moderation Will Get Stricter
Platforms facing DSA obligations will inevitably tighten content moderation. Expect more automated content scanning, more false-positive takedowns, and longer review times for content that triggers automated flags. Creators should familiarize themselves with their platform's internal complaint mechanism (required by Article 20) to contest erroneous takedowns.
Transparency Reports Are Public Intelligence
The DSA's transparency reporting requirements mean that platforms must publish data on content moderation volumes, categories, and outcomes. Creators and industry analysts will, for the first time, have reliable data on how much content platforms remove, for what reasons, and how accurate their automated systems are. This data can inform creators' platform choices.
EU-Based Creators Face Additional Obligations
Creators established in the EU who operate their own websites (rather than posting exclusively on third-party platforms) may themselves qualify as "hosting services" under the DSA if they store and display user-generated content — for example, user comments or submitted media. In that case, they would be subject to the notice-and-action obligations of Articles 16-18.
Data Access Provisions Matter
Article 40 requires VLOPs to provide data access to vetted researchers. This will generate new research on content moderation practices, algorithmic amplification, and platform dynamics in the adult content space. Creators should pay attention to this research as it emerges, because it will likely influence future regulatory proposals.
The UK Comparison: The Online Safety Act
Creators and platforms should also understand the UK's Online Safety Act 2023, which took a different but parallel approach. The UK law imposes duties on platforms to protect users from illegal content and to protect children from harmful content, with enforcement by Ofcom. Adult content platforms must implement "highly effective" age verification under the UK framework. The penalties are similarly severe: up to 10% of global annual turnover or 18 million pounds, whichever is greater.
The UK and EU frameworks differ in structure but converge on outcomes: platforms hosting adult content must verify user ages, moderate content proactively, and face substantial financial penalties for failure.
Looking Ahead
The DSA is not a static regulation. The European Commission has the power to adopt delegated acts and implementing regulations that add detail to the DSA's framework. In 2025, the Commission published draft guidance on age verification technologies and algorithmic transparency that will further shape platform obligations.
For adult content platforms and creators operating in the EU market, the DSA represents a permanent shift in the regulatory environment. Compliance is not a one-time project but an ongoing operational requirement. Platforms that treat it as such will survive. Those that do not will eventually face enforcement actions that could reshape or end their European operations.
